(Worthy News) – President Donald Trump banned CNN, MS NOW and Politico from the White House after accusing the organizations of repeatedly publishing “fake news,” setting off a constitutional fight over press access to the nation’s executive branch.

Trump announced the restrictions Friday, saying they were effective immediately. Asked how the decision squared with the First Amendment, the president argued that the Constitution did not require him to admit the organizations to the White House.

“You need a free press. You need a fair press and an honest press,” Trump told reporters. He maintained that the three organizations had produced one-sided coverage intended to damage his administration and Republican officials. Trump also suggested that other news organizations could face similar restrictions. Newsmax reported that the president attributed his decision to what he called a pattern of reporting over the previous two years.

The ban moved beyond presidential rhetoric Saturday when CNN correspondent Betsy Klein, MS NOW reporter Akayla Gardner and Politico correspondent Cheyenne Haslett were denied entry to the White House complex. Their credentials were deactivated or confiscated, according to subsequent reports.

Outlets Take the White House to Court

CNN, MS NOW and Politico responded Monday by filing a joint lawsuit against the Trump administration, arguing that the government had violated their First Amendment rights by revoking access because of the content of their reporting.

“Without notice or process, the White House revoked our journalists’ credentials because it objected to our reporting,” the organizations said in a joint statement. They warned that allowing the ban to stand would threaten both press freedom and the public’s access to independent reporting.

The complaint alleges that the administration engaged in viewpoint discrimination—government action directed at speakers because of what they say or publish. The outlets are asking the federal court to restore their reporters’ access. The case was assigned to U.S. District Judge Timothy Kelly, a Trump appointee. The Associated Press reported that the lawsuit was filed in the names of the three organizations and the three correspondents turned away Saturday.

Trump rejected the charge that he was attacking press freedom. In a Monday statement, he said the White House was acting against what he considers deliberately false reporting, not the free press itself.

That distinction will now face judicial scrutiny. The administration argues that the president retains authority over access to secure and restricted White House spaces. The plaintiffs contend that access cannot be withdrawn as punishment for reporting the president dislikes.

Dispute Spreads to the White House Press Pool

The confrontation quickly affected coverage beyond the three banned organizations.

CNN had been scheduled to serve Monday as the television pool network covering Trump’s trip to New York for the United Nations General Assembly. The rotating pool allows one television organization to record presidential events in confined settings and distribute the footage to other news outlets.

After the White House prevented CNN from fulfilling that assignment, the five-network television pool declined to provide a substitute crew. As The Wall Street Journal reported, the dispute therefore threatened to leave presidential events without the customary independent television coverage shared across the press corps.

The Associated Press likewise reported that the pool notified its members there would be no replacement coverage. The decision represented a coordinated response from television organizations that ordinarily compete intensely for access and audiences.

The White House Correspondents’ Association called for the credentials to be restored. Its president, Fox News correspondent Jacqui Heinrich, warned that a standard used to exclude one organization because of its reporting could later be applied to others.

“The American people, through a free and independent press, must be able to scrutinize those elected to power, regardless of whether government officials view it favorably,” Heinrich said.

The lawsuit now places two competing claims before the courts: the president’s asserted authority to control physical access to the White House and the news organizations’ argument that the government cannot use that authority to punish constitutionally protected reporting.
